Hirit na writ of amparo ni Atty. Harry Roque, ibinasura ng SC

Hindi pinagbigyan ng Korte Suprema ang hirit na writ of amparo ni Atty. Harry Roque, laban sa pagpapa-aresto at pag-contempt sa kaniya ng Quad Committee ng Kamara.

Sinabi ni Supreme Court (SC) Spokesperson Atty. Camille Ting, na maling remedyo ang writ of amparo dahil ito ay para lang sa extralegal killings at enforced disappearances na wala sa kasalukuyang kaso.

Gayunman, ipinag-utos ng Korte Suprema sa Quad Committee na magkomento sa loob ng 10 araw sa petisyon ni Roque, na humihiling na pigilan ng SC ang pagpapahuli at pagpapatawag sa kaniya at pagprisinta ng mga dokumento sa hearing.

Iginiit ni Roque sa kaniyang petisyon na Iligal ang arrest order ng Kamara dahil ito ay mula sa abusado at mapang-aping akto ng Quad Comm.

Ayon kay Ting, “The Court denied Roque’s prayer for the writ of amparo. It held that amparo is not the proper remedy against Congressional contempt and detention orders. The scope of amparo is limited to extralegal killings and enforced disappearances, or threats thereof, which are not present in this case.”
