Interment services sakop ng senior citizen’s discount– SC
Kasama sa 20% na diskuwento sa funeral at burial expenses ng pumanaw na senior citizen ang interment services sa ilalim ng Senior Citizens Act.
Ito ay batay sa desisyon ng Supreme Court En Banc na kumakatig sa petition for review na inihain ng Office of the
Solicitor General, Office of the Senior Citizens Affairs, at Department of Social Welfare and Development.
Sa ruling ng SC, ipinawalang-bisa nito ang mga resolusyon ng Cagayan de Oro City Regional Trial Court (RTC) Branch 17 na nagtatanggal sa
interment services mula sa coverage ng senior citizen discount sa funeral at burial services.
Ayon sa SC, sa ilalim ng Senior Citizens law at Expanded Senior Citizens Act ay walang eksaktong depenisyon ang funeral and burial services.
Pero hindi naman anila nililimitahan ng mga batas ang sakop ng mga nasabing serbisyo.
Ayon sa SC, batay sa depenisyon o sa pangkaraniwang pagkakaunawa, ang burial service ay tumutukoy sa alinmang serbisyo na may kaugnayan sa paglilibing.
Dahil dito, sinabi ng SC na normal lang na kasama sa burial services ang paghukay sa lupa ng paglilibingan, pag-semento at iba pang serbisyo sa aktuwal na libing.
“The Court found that the exclusion by the RTC of interment services from the coverage of the 20% senior citizen discount is not provided under the law, and the IRR, which does not explicitly exclude interment services, cannot be interpreted to support the lower court’s resolution,” nakasaad pa sa desisyon ng SC.
