SC inatasan ang Palasyo at Kongreso na sagutin ang petisyon laban sa paglipat ng pondo ng PhilHealth
Pinagsusumite ng Korte Suprema ng komento ang Malacañang at ang dalawang Kapulungan ng Kongreso sa petisyon na inihain laban sa paglipat ng pondo ng PhilHealth sa national treasury.
Ayon kay Supreme Court Spokesperson Atty. Camille Ting, binigyan ng 10 araw ang respondents na sagutin ang petisyon na kumukuwestiyon sa legalidad ng PhilHealth fund transfer.
Ang petisyon ay inihain ng iba’t ibang grupo noong Agosto 2, 2024.
Kabilang sa respondents ng petisyon ang Kamara, Senado, Finance Secretary Ralph Recto, Executive Secretary Lucas Bersamin, at PhilHealth Pres. Emmanuel Ledesma Jr.
Partikular na ipinadedeklarang labag sa Konstitusyon ng petitioners ang probisyon sa 2024 General Appropriations Act (GAA) na nag-ootorisa sa paglipat ng pondo ng mga Government Owned and Controlled Corporations (GOCCs) para pondohan ang unprogrammed projects.
Hiniling din ng petitioners na ipatigil ng SC sa Department of Finance (DOF) ang paglipat ng halos P90 bilyong PhilHealth funds at ipabalik ang nasa P20 bilyong pisong nailipat na.
“ The Court required the respondents to file their Comment to the petition and prayer for TRO within a non-extendible period of 10 days from notice.
