SC iniutos ang pagtatalaga ng provincial treasurer ng Maguindanao Del Norte
Pinaboran ng Korte Suprema ang inihaing petition for mandamus ng Maguindanao Del Norte Provincial Government na kinakatawan ni Governor Fatima Ainee Sinsuat.
Sa 18-pahinang desisyon ng Supreme Court Second Division na isinulat ni Associate Justice Amy Lazaro- Javier, inatasan nito ang Bureau of Local Government Finance (BLGF) Regional Office No. XII na ituloy ang proseso ng appointment ni Badorie M. Alonzo o sinumang mga kuwalipikado bilang provincial treasurer na itatalaga ni Sinsuat.
Ang petisyon ay nag-ugat sa pagtanggi ng BLGF na aksyunan ang hiling ni Sinsuat sa pagtatalaga ng ingat-yaman para sa Maguindanao Del Norte para magamit na ng lalawigan ang pondo nito sa mga proyekto.
“Here, we cannot allow the newly created Province of Maguindanao del
Norte to be crippled without its provincial treasurer who discharges the vital
task of managing the fiscal affairs of the province as the same affects the entire
operation of the local government unit… Prompt action by the Court is thus necessary and exigent in this situation,” sabi sa desisyon ng SC Second Division.
Sa ruling ng SC, sinabi rin na may malinaw na legal na karapatan si Sinsuat na magrekomenda ng itatalaga na provincial treasurer ng lalawigan.
Ayon pa Korte Suprema, tungkulin ng BLGF na iproseso ang rekomendasyon ni Sinsuat sa nasabing posisyon sa Maguindanao Del Norte.
Nilabag at bigo rin umano ng BLGF na gampanan ang ministerial duty nito na kilatisin at iranggo ang mga inirekomenda sa local treasury positions.
