Anti- Terror Law, natalakay sa pagharap ng UN Special Rapporteur sa SC Magistrates
Humarap sa mga mahistrado ng Korte Suprema si UN Special Rapporteur for Freedom of Expression and Opinion Irene Khan.
Ayon sa Supreme Court, isa sa mga napag-usapan ay ang isyu ng batas kontra terorismo.
Binigyan si Khan ng kopya ng pinagtibay ng SC na mga panuntunan sa paghawak ng mga korte sa mga kaso kaugnay sa Anti-Terrorism Law.
Sinabi ni Chief Justice Alexander Gesmundo na binalangkas ng SC ang nasabing rules para masiguro na maayos na mahahawakan ng mga hukom ang anti- terror cases at maproteksiyonan ang karapatan ng mga tao.
Binanggit din ng SC kay Khan na may ilang probisyon ng Anti-Terror Act of 2020 na di sumasang-ayon sa Saligang Batas partikular ang mga lumalabag sa freedom of expression.
“Actually, it said we can only rule upon on its face with respect to certain provisions that clearly violate freedom of expression. And therefore, We went on to strike down certain conditions which were vague in terms of the definition of the Anti-Terror Law ” ani naman Senior Associate Justice Marvic Leonen.
Tiniyak din ni Gesmundo sa Special Rapporteur na mataas ang kabatiran ng hudikatura ng Pilipinas sa prinsipyo ng freedom of speech and expression at binabalanse ang kalayaan at karapatan ng estado na proteksyunan ang sarili.
“ Philippine Judiciary is highly cognizant of the universal principles of freedom of speech and expression as enshrined in the Philippine Constitution and International Laws, and that the courts always seek to actively endeavor in striking a balance between such freedoms and the right of the state to protect itself ” pahayag ng Korte Suprema
