DOJ naniniwalang may mabuting rason ang Gobyerno sa hindi pagsasapubliko sa presyo ng mga biniling COVID vaccines
Pinapayagan sa ilalim ng Government Procurement Law ang pagpasok sa mga negotiated procurement ng pamahalaan sa mga emergency cases gaya ng banta sa buhay sa panahon ng State of Calamity.
Ito ang tugon ni Justice Secretary Menardo Guevarra sa isyu ng hindi pagsasapubliko ng gobyerno sa presyo ng mga biniling bakuna kontra COVID-19.
Aminado ang kalihim na hindi niya nabasa ang Tripartite agreement na pinasok ng national government, LGUs, at vaccine manufacturers kaya hindi siya makapagkomento kung batay sa sound policy ang probisyon sa nondisclosure ng presyo ng COVID vaccines.
Pero sinabi ni Guevarra na maaaring may mabuting dahilan sa non-disclosure sa mga commercial terms ng kasunduan gaya ng price competition at distribution channels.
Paliwanag pa ni Guevarra, ang Tripartite Agreement ay malawak na preparatory agreement na susundan ng aktwal na supply contracts na kinapapalooban ng mga specific terms gaya ng presyo.
Gayunman, naniniwala ang kalihim na mahalagang may absolute transparency ukol sa safety at efficacy ng mga bakuna laban sa COVID dahil nakasalalay dito ang buhay ng mamamayan.
SOJ Menardo Guevarra:
“There may be some good reason for non-disclosure of the commercial terms (price competition, distribution channels, etc). I believe, however, that absolute transparency is necessary in relation to the safefy and efficacy of the vaccine, as the very lives of our people are at stake.
Our procurement law expressly authorizes negotiated procurement by government in emergency cases such as when there is imminent danger to life during a state of calamity.
I have not seen the tripartite agreement among the national government, the LGU sector, and the vaccine manufacturer, so i am not in a position to comment on whether the non-disclosure provision is anchored on a sound policy basis.
What i know, however, is that the tripartite agreement is a broad preparatory agreement, to be followed by actual supply contracts containing specific terms, such as on pricing“.
